Psystar Files Counter Suit Against Apple
When you’re a smaller company and a bigger fish sues you, what’s the best course of action? Well to sue them right back of course. That’s the path that Psystar is taking, for better or worse, as they will be counter suing Apple.
Rudy Pedraza, the owner of Miami based Psystar will be filing a lawsuit based on the Sherman Antitrust Act, and Clayton Antitrust Act. If you’re getting a sense of deja vu, these are the same kind of charges that Microsoft went through during the mid 90’s. When they were accused of being a monopoly. Pedraza’s claim is that Apple is violating these antitrust acts by tying the Mac OS together with Apple hardware.
Pedraza has also defended against the lawsuit Apple has out on Psystar. Here is a quote from a recent press conference, “My goal is to provide an alternative, not to free the Mac OS….What we want to do is to provide an alternative, an option…It’s not that people don’t want to use Mac OS, many people are open to the idea, but they’re not used to spending an exorbitant amount of money on something that is essentially generic hardware.”
According to many legal experts, Psystar is going to have a tough time proving Apple violated any antitrust laws.
I’m not a lawyer, but I really don’t see how Psystar is going to win this case.
